Sweet Truth

So, how were your holidays? I do hope they were filled with everything your heart desired!

Cynthia Kelly, Florida Woman, got the gift of Something Picayune Over Which To File A Lawsuit when she went to her local ALDI and got herself a $4.49 bag of holiday design peanut butter candy. And what stuck to the roof of her mouth is that some Reese's products do not look like their photos do on their wrappers.

Ms Kelly is hauling the Hershey Company, makers of Reeses, into U.S. District Court in the Middle District of Florida. She is highly upset that, f'instance, Reese's peanut butter pumpkins are nothing but pumpkin-shaped hunks of peanut-butter-stuffed chocolate, with no Jack O'lantern-style carvings...but the wrapper shows those carvings.

And to her horror, she found the same thing to be true for the peanut butter footballs and bats, as well as the white chocolate ghosts.

Some law office actually typed on the court papers that the wrapper led Kelly to believe "the product contained a cute-looking carving of a pumpkin's mouth and eyes as pictured on the product packaging."

Ladies and gentlemen of the jury, the evidence will show that Reese's sold a candy football that HAD NO CARVED LINES to look like stitching on a football.

The suit avers "Plaintiff and the members of the Class have been aggrieved by Defendant's unfair and deceptive practices. They purchased the Products with the reasonable expectation that the Products would look similar to the pictures displayed on the Products' packaging."

Ms Kelly and her lawyers say a quick five million simoleons will help her get over it.

I think she's represented by the same firm that represented Otis Campbell when he sued Mayberry.

Only rational thought for what this poor put upon lady was thinking was that she wanted to use them as some sort of decor for some edible goodies, and thought the little pumpkin faces would look cute on,say a cupcake for little Susies class party. Oh well...

I hope the judge at least laughs them both out of court.
